Terms of Use
Article 1 — Purpose and scope
These Terms of Use (the “Terms”) govern access to and use of the TrustedPulse platform available at www.trustedpulse.com and any associated sub-domain, API or mobile application (the “Platform”), operated by Nova Impact Ltd, a company registered in England and Wales, trading as “TrustedPulse” (“TrustedPulse”, “we”, “us”).
The Terms apply to every person accessing the Platform, whether as the author of a review (a “Consumer” or “Reviewer”) or as a subscribing business (a “Customer”). They form a legally binding agreement between the User and TrustedPulse. By accessing the Platform or submitting a review, you accept these Terms without reservation.
Unlike open review platforms, TrustedPulse is a closed, verified platform. Only consumers who have received an official invitation linked to a real, verifiable transaction may submit a review. This rule is absolute and is the foundation of the value of the “Verified Review” badge.
Article 2 — Definitions
Each capitalised term below has the meaning given to it, whether used in the singular or the plural:
- Verified Review: any review collected via the Platform on the basis of an Invitation linked to a verifiable commercial transaction, bearing the official “TrustedPulse Verified Review” badge.
- Back Office: the web interface reserved for Customers, accessible after authentication, giving access to the features of the subscribed Solutions.
- Customer or Business: any natural or legal person subscribing to a paid TrustedPulse plan to manage its online reputation.
- Consumer or Reviewer: a natural person who has received an official Invitation and submits a review on the Platform.
- User-Generated Content (UGC): any written review, star rating, photo, video or comment published by a Consumer on the Platform.
- Invitation: a unique, secure link sent by TrustedPulse to a Consumer, cryptographically linked to a transaction reference, enabling the submission of a review.
- Platform: all TrustedPulse services accessible via www.trustedpulse.com, its sub-domains, APIs and mobile applications.
- Intellectual Property: all intellectual-property rights, registered or not, including without limitation copyright, trade marks, patents, database rights, know-how and trade secrets.
- Data Protection Legislation: the EU GDPR (Regulation (EU) 2016/679), the UK GDPR and the Data Protection Act 2018, the French Data Protection Act, and any other applicable national regulation.
- Service or Solution: the SaaS services provided by TrustedPulse, described in the Business Terms of Service.
- Widget: the customisable JavaScript module developed by TrustedPulse, embedded on the Customer’s website, displaying collected reviews and injecting Schema.org structured data for search-engine optimisation.
- User: any person accessing the Platform, whether a Consumer or a representative of a Customer.
Article 3 — Access to the Platform and verification system
3.1 Access conditions for Consumers
Access to the Platform as a review author is conditional upon receipt of an official Invitation. Any attempt to submit a review without a valid invitation token is automatically rejected by the system. By accessing the Platform through an Invitation link, the Consumer declares that they:
- are at least 18 years old;
- have genuinely purchased a product or used a service of the business concerned, corresponding to the transaction linked to their Invitation; and
- accept these Terms without reservation before submitting any review.
3.2 Verification mechanism
Each Invitation is cryptographically linked to a transaction reference (order number, service date, customer identifier). The invitation token is single-use and expires 90 days after issuance. Upon submission, the system automatically validates the match between the token and the transaction recorded in the database.
3.3 Customer access
The Customer accesses its Back Office using personal credentials. The Customer is solely and entirely responsible for the confidentiality of its credentials and for any use made through its account, and undertakes to notify TrustedPulse immediately of any unauthorised use at [email protected].
Article 4 — TrustedPulse core commitments
- TrustedPulse publishes 100% of verified reviews, positive and negative, without exception.
- No selection of consumers is ever made on the basis of their purchase profile.
- TrustedPulse cannot be paid to delete, alter or hide a review.
- A published review bears the “Verified Review” badge only if it is linked to a proven transaction.
- A Consumer may amend their review within 90 days of writing it.
- Beyond 90 days, the Consumer may only request the withdrawal of their review.
- Any moderated review is explained to its author within 5 business days.
Article 5 — Review-writing rules
5.1 Permitted content
A review must describe the Consumer’s genuine personal experience with the business concerned. It must be written in the first person, in intelligible language, and submitted within the period stated in the Invitation.
5.2 Prohibited content
Reviews containing any of the following are expressly prohibited:
- false information, unsubstantiated allegations or deliberate exaggerations;
- defamatory, insulting, threatening or harassing statements;
- discriminatory statements based on origin, sex, family situation, sexual orientation, gender identity, age, political opinions, trade-union activity, or religion or belief;
- personal data of third parties (names, addresses, telephone numbers, banking information);
- confidential information about the business concerned (contracts, strategies, trade secrets);
- promotional content, advertising or spam;
- references to ongoing legal proceedings;
- content infringing third-party Intellectual Property rights (protected texts, photos or videos used without authorisation).
5.3 Moderation
TrustedPulse operates a pre-publication moderation process combining automated AI analysis and human review, designed to comply with the requirements of the NF ISO 20488 standard on online consumer reviews (certification in progress). TrustedPulse reserves the right to reject or remove a review that breaches these rules. The author is informed of the reason for rejection within 5 business days and may appeal to [email protected]. Article 6 — Intellectual property
6.1 TrustedPulse property
TrustedPulse owns all Intellectual Property rights in the Platform, including source code, algorithms, interfaces, databases, trade marks, logos and associated documentation. These Terms transfer no TrustedPulse Intellectual Property rights to the User.
6.2 Licence granted by the Consumer
By submitting a review, the Consumer retains ownership of their content and grants TrustedPulse a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence, for the full legal term of protection, for the following purposes:
- display of the review on the Platform and through Widgets embedded on Customers’ websites;
- indexing and search-engine visibility through Schema.org structured data (including AggregateRating);
- anonymised and aggregated statistical analysis to improve the Service;
- artificial-intelligence processing for the purposes set out in Article 8, subject to the right to object provided there.
Article 7 — Liability
7.1 Consumer’s liability
The Consumer is solely responsible for the content they publish on the Platform and shall indemnify TrustedPulse against any third-party claim arising from unlawful content they have published. Where a review is reported as unlawful by a third party, TrustedPulse may suspend the review pending investigation under the adversarial reporting procedure described in the Transparency Charter.
7.2 TrustedPulse’s liability
TrustedPulse does not warrant the accuracy of the information contained in published reviews, which reflect only the personal opinion of their authors. TrustedPulse acts as a hosting provider within the meaning of the applicable rules on intermediary liability, including the EU Digital Services Act and, in France, the Law on Confidence in the Digital Economy (LCEN).
Article 8 — Artificial-intelligence processing
TrustedPulse uses artificial-intelligence systems (including the OpenAI API) for the following purposes:
- analysis of sentiment and topics mentioned in reviews;
- generation of contextual reply suggestions for Customers;
- detection of potentially fraudulent reviews (suspicion score of 0–100);
- identification of trends across review collections;
- automated generation of weekly reputation reports.
AI processing applies to the text content of reviews only. Personal identifiers (first name, email address, IP address) are excluded from AI inputs. A Consumer may object to AI processing of their review by writing to [email protected]; the review remains published but is excluded from AI analysis.
Article 9 — Submitting, amending and withdrawing a review
- The Consumer may amend their review within 90 days of its initial submission.
- Beyond 90 days, any amendment requires a written request to [email protected] with supporting reasons.
- The permanent withdrawal of a review may be requested at any time; it results in the deletion of the review and all associated data within 30 days.
- Where duplicate reviews are submitted (same Consumer, same business, same period), only the most recent review is retained.
Article 10 — Personal data
Personal data collected in connection with the Platform is processed in accordance with the TrustedPulse Privacy Policy and, for Customers, the Data Processing Agreement, in compliance with the EU GDPR, the UK GDPR and applicable national data-protection laws. Article 11 — Reporting content
Any User or third party may report a review or other content that they consider unlawful or contrary to these Terms, either through the reporting feature displayed alongside the content or by writing to [email protected] (see the Legal Notice). Reports are examined under the adversarial procedure described in the Transparency Charter. Misuse of the reporting feature — including repeated reports made in bad faith — is not tolerated and may lead to the loss of access to it.
Article 12 — Changes to the Terms
TrustedPulse may amend these Terms at any time. Substantial changes are notified by email to registered Users at least 30 days before they take effect. Non-substantial changes (editorial corrections, technical clarifications) may be implemented without notice. Continued use of the Platform after notification constitutes acceptance of the new Terms. In case of disagreement, the User may close their account without penalty.
Article 13 — Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. If a dispute is not resolved amicably within 30 days, the courts of England and Wales shall have exclusive jurisdiction, except where mandatory rules of the law of the User’s habitual residence provide otherwise — including, where applicable, French or Moroccan consumer-protection law.
For consumers residing in France: in the event of a consumer dispute, you may also refer the matter to the competent consumer mediator in accordance with Articles L.611-1 et seq. of the French Consumer Code.
